Terms of Service

These Terms of Service ("Terms") govern your use of Fidant.AI ("the Service"), operated by Liberty.space Corp, a Delaware (USA) stock corporation ("we," "us," or "our"). Fidant.AI is a product of Liberty.space Corp. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Paid subscriptions are additionally governed by our Public Offer.

01The Service

Fidant.AI is an AI assistant with persistent memory for executives. The Service allows you to have conversations with frontier AI models (Claude, GPT, Gemini) while maintaining a persistent context layer that carries knowledge across conversations. The authoritative copy of your memory is stored in our database; a synchronized projection is written to your personal Google Drive for your direct access and control.

The Service also includes optional features such as health biomarker tracking, wearable device integrations (Whoop, Oura Ring), voice input transcription, conversation sharing, and server-side encryption of context files.

The Service is provided "as is" and "as available." We do not guarantee that AI-generated responses are accurate, complete, or suitable for any particular purpose. You are solely responsible for decisions made based on information provided by the Service.

02Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this requirement. The Service is intended for professional and personal productivity use by individuals.

03Your Account

You sign in using your Google Account. You are responsible for maintaining the security of your Google Account credentials. You agree to notify us immediately if you become aware of unauthorized access to your account.

You may have only one active account. Creating multiple accounts to abuse free trials or circumvent usage limits is a violation of these Terms and may result in account termination.

04Your Data

You own your data. We do not claim ownership of any content you create or store through the Service. The authoritative copy of your memory, conversation history, and extracted context is stored in our database (see the Privacy Policy for detail); memory files are also projected to your personal Google Drive, where you can view, edit, export, or delete them at any time.

By using the Service, you grant us a limited license to access, read, and modify files within the Fidant.AI folder on your Google Drive solely for the purpose of providing the Service. This license terminates when you revoke access or delete your account.

You grant us a limited license to send your messages and context data to third-party AI model providers to generate responses and run internal operations: Anthropic, OpenAI, and Google for the models you select; OpenAI for embedding generation and voice transcription; and Xiaomi (MiMo) and DeepSeek models for internal classification, routing, and analysis tasks. We use API access, not consumer products. Anthropic, OpenAI, and Google do not use API-submitted data for model training under their standard API terms; data routed to Xiaomi (MiMo) and DeepSeek is subject to those providers' own API terms (see the Privacy Policy, Sections 04, 13, and 18).

05Shared Conversations

You may share conversations by generating a unique link. When you share a conversation, a snapshot including your name and the conversation content is stored on our servers and becomes accessible to anyone with the link. You are responsible for the content of conversations you choose to share. You can revoke a shared link at any time.

We reserve the right to remove shared conversations that violate our Acceptable Use policy (Section 07).

06Subscriptions & Billing

Fidant.AI offers a free trial and paid subscription tiers. The current tiers, pricing, and included features are displayed on our website and may change with notice.

• Free Trial: 14 days, limited daily messages, no credit card required
• Starter: $19/month, 30 messages per day, all AI models
• Pro: $59/month, 100 messages per day, all AI models
• Executive: $199/month, 500 messages per day, all AI models + GPT-5.5 Pro

Paid subscriptions are billed monthly through Stripe. You may cancel at any time — your subscription remains active until the end of the current billing period. We do not offer refunds for partial months.

We reserve the right to change pricing with 30 days' notice. Price changes do not affect your current billing period.

07Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Generate, store, or distribute harmful, abusive, or illegal content
• Attempt to reverse-engineer, decompile, or extract the source code of the Service
• Interfere with the Service's operation or other users' access
• Create multiple accounts to abuse free trials or usage limits
• Share conversations containing another person's private or sensitive information without their consent
• Resell, sublicense, or commercially redistribute access to the Service without our written consent
• Use the Service to build a competing product

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

08AI Limitations & Disclaimer

The Service uses third-party AI models to generate responses. AI outputs may be inaccurate, incomplete, or inappropriate. The Service does not provide medical, legal, financial, or professional advice. Always consult qualified professionals for important decisions.

We do not guarantee the accuracy or reliability of any AI-generated content, including but not limited to health data interpretation, financial analysis, or strategic recommendations.

09Health Data

The Service includes features for tracking health biomarkers, lab results, and wearable device data (Whoop, Oura Ring). This is for personal informational purposes only and does not constitute medical advice, diagnosis, or treatment. The Service is not a medical device.

Health data you upload or that is retrieved from connected wearable devices is stored in our database (with raw lab-report text on our object storage), and health-related memory is projected to your Google Drive. Unit conversions and status indicators are computed algorithmically and may contain errors. Always verify health data with your healthcare provider.

10Encryption

The Service offers optional server-side encryption of your context files using AES-256-GCM. When enabled, files are encrypted before being written to Google Drive and decrypted when read. Encryption keys are generated and stored on our servers. This feature protects data at rest on Google Drive but is not end-to-end encryption — our servers process plaintext during normal operation. We do not guarantee that encryption prevents all unauthorized access.

11Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Liberty.space Corp and protected by intellectual property laws. Your subscription grants you a personal, non-transferable, non-exclusive license to use the Service for its intended purpose.

12Limitation of Liability

To the maximum extent permitted by law, Liberty.space Corp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or business interruption.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

13Third-Party Services

The Service integrates with third-party services including Google (authentication, Drive storage, Calendar), Apple (Sign in with Apple), Anthropic, OpenAI, Google AI, Xiaomi (MiMo), and DeepSeek (AI model providers and embeddings), Stripe (payments), PostHog (analytics), Postmark (email delivery), Telegram (messaging integration), Whoop (wearable health data), and Oura (wearable health data). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

14Termination

You may terminate your account at any time by contacting us. We may terminate or suspend your account for violation of these Terms or for any other reason with 30 days' notice (or immediately in cases of abuse or illegal activity).

Upon termination, your Google Drive data remains yours. Server-side account data (including wearable device tokens, encryption keys, and shared conversation snapshots) is deleted within 30 days.

15Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance.

16Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Mandatory consumer-protection rules of the country of your residence remain unaffected to the extent they apply by law.
